Giffords and California Attorney General Sue ATF Over “80 Percent” Receivers

The anti-gun group, Giffords Law Center, joined California's anti-gun Attorney General, Xavier Becerra, to file a lawsuit against the U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives over DIY gun kits. ATF has a policy of not regulating "80 percent" receivers as long as they’re made by individuals who qualify to own firearms.

Additionally, such components are free from federal regulations as long as they do not qualify as one of the devices controlled by the National Firearms Act, such as machine guns or suppressors.

Hannah Shearer, Giffords Litigation Director compared making a ghost gun with assembling Ikea furniture.

“If you can assemble Ikea furniture, you can definitely build a ghost gun,” Hannah Shearer said. “And you’ll probably be able to do it faster: there are kits and tools that let you assemble a ghost gun in under 15 minutes. Yet for no reason at all, the parts used to build ghost guns aren’t treated as firearms under federal law."

Becerra claims that changing the current ATF's policy would benefit California and was part of the enactment of the "common-sense” gun laws in the Golden State.

Everytown and some Blue cities namely Syracuse, NY, San Jose, CA, Chicago, IL, and Columbia, SC, have taken similar steps to push for federal control of unfinished firearms.

The national anti-gun groups want the federal government to classify such components as firearms and impose federal regulations such as serial numbers and background checks. The groups have also taken part in campaigns to ban "ghost guns" in various states.

Meanwhile, Lt. Gov. Dan Patrick is pushing universal background checks in our state, and if left unchecked, it will not be long until we see bills like this getting traction in Austin. Texas is embarrassingly ranked 29th for gun rights, and with the help of the political elites in Austin, we will surely rank among New York, California, and Illinois if left to their own devices. Please join our fight today, and help us restore Texas' place as the standard for the U.S.
