Kicking and Screaming, Susan Holmes Arrested for Lying to have Officer’s Guns Taken Under Red Flags
Fort Collins, Colorado: Police have arrested Susan Holmes, one of the most wanted people in Larimer County, Colorado. Ms. Holmes is accused of lying to the court to have an officer’s firearms confiscated under the Extreme Risk Protection Orders. The detainee alleged that she shared a child with Corporal Phillip Morris in order to qualify as a close relation to attain the threshold necessary for the execution of the red flag laws.
The laws demand that a person who makes the extreme risk protection order request must be a family member or a domestic resident for the request to be honored. Ms. Holmes refused to provide any evidence of sharing a child with the officer and accused the judge of bias leading to the denial of her request.
The police arrested the 64-year-old woman during a live stream where she could be heard screaming. Larimer County Sheriff Justin Smith issued the arrest warrant after investigations revealed that the detainee had lied about having joint custody of the child with the officer.
“That investigation revealed she had in fact perjured herself on that form,” Sheriff Smith said in an interview with CBS4. The sheriff said the arrest was to deter individuals from abusing the law in the future.
Opponents of the red flag law had indicated that it was prone to misuse by disgruntled relatives and close parties. Some versions of the extreme risk protection orders proposed or passed by some states allow employers, doctors, teachers, and colleagues to request confiscation of firearms from employees, patients, students, and coworkers who they suspect is a risk to themselves and others.
Unlike the case of corporal Morris, most people would have their firearms confiscated for 14 days before a hearing takes place. During this period, the victims’ lives would be at risk regardless of the outcome.
