Sen. John Kennedy (R-LA) sponsored the Veterans Second Amendment Act to prevent them from losing their gun rights when they receive assistance from the Department of Veterans Affairs (VA) in managing their benefits. Sen. Kennedy said that the veterans earned their VA benefits by serving the country and the government should not punish them for assisting them.
“Veterans who sacrificed to defend our Constitution shouldn’t see their own rights rest on the judgment of unelected bureaucrats—but right now, they do,” Kennedy said. “The Veterans Second Amendment Protection Act will prevent government workers from unduly stripping veterans of their right to bear arms,” said Kennedy.
Currently, a VA beneficiary’s name is entered into the FBI’s National Instant Criminal Background Check System (NICS) whenever the VA appoints a fiduciary to assist a veteran in managing his or her VA benefits. Essentially, a veteran becomes a criminal for receiving the assistance he or she needs after serving the country. Consequently, almost millions of veterans lose their rights to self-defense despite having suffered to protect the country.
Additionally, bureaucrats at the VA decide if a veteran should receive a fiduciary. Many veterans are, therefore forced to sacrifice their rights in exchange for the benefits. This also denies the veterans the right to due process as guaranteed in the Fourth Amendment rights. It seems that the constitution works for everybody except for the people who sacrificed to defend it. Additionally, it is a disguised form of Red Flag law, which only applies to veterans.
Under the current bill, the Secretary of Veterans Affairs will be prohibited from entering the veteran’s personal information into the NICS unless a judge rules that he or she is a danger to self and others.
Meanwhile, Joe Biden promised to “reinstate the Obama-Biden policy to keep guns out of the hands of certain people unable to manage their affairs for mental reasons, which President Trump reversed.”
President Trump nullified the Implementation of the NICS Improvement Amendments Act of 2007 that required individuals fitting specific criteria and receiving the Supplemental Security Income (SSI) payments under title XVI of the Act or Disability Insurance benefits under title II of the Social Security Act (Act) or through a representative payee to be entered into the NICS.
Over the years, Democrats have failed to prove why such individuals are considered a threat. But I guess it feels good for the Democrats to categorize individuals as criminals without justification.
