TEXAS- Gov Signs Brass Knuckle Bill

Texas Governor Greg Abbott has signed legislation lifting the ban on brass knuckles, tomahawks and other self defense items. The piece of legislation will take effect across the State on Sept. 1, 2019.

Rep. Joe Moody,D-El Paso authored HB446 that removes KNUCKLES from the prohibited list in Sec 46.05(A)(2) stated that he filed HB446 because he had seen news of a female being arrested for the possession of a self-defense keychain tool that falls under the Legal Classification of Knuckles.

Rep. Joe Moody, said the bill was "another step" toward getting rid of" antiquated laws regarding weapons." "We did it with switchblades. We did it with knives and now with knuckles". "Hopefully, now, with this on the way to the governor, we can ensure these types of laws aren't being used inappropriately to go after folks who have legitimate tools of self defense."

The Knuck Bill was amended while in the Texas House to also include removing "CLUB's" from the prohibited weapons list as well. This amendment broadly enhanced the bill to include many more self defense items such as Blackjacks, Nightsticks, Mace, Tomahawks, and more.

The Texas Penal Code 46.01 (1) defines Club as follows:

(1) “Club” means an instrument that is specially designed, made, or adapted for the purpose of inflicting serious bodily injury or death by striking a person with the instrument, and includes but is not limited to the following:

(A) blackjack;

(B) nightstick;

(C) mace;

(D) tomahawk.
