A Liberal professor who appeared during Trump's impeachment proceedings and accused him of "impeachable high crimes and misdemeanors by corruptly abusing the office of the presidency" supported his Supreme Court nominee. The Harvard Law School professor said Barrett was highly qualified for the position.
"These political judgments need to be distinguished from a separate question: what to think about Judge Amy Coney Barrett," Noah Feldman wrote. "And here I want to be extremely clear. Regardless of what you or I may think of the circumstances of this nomination, Barrett is highly qualified to serve on the Supreme Court."
However, Feldman said he disagreed with her judicial philosophy and expected to disagree with most of her decisions and opinions.
"Yet despite this disagreement, I know her to be a brilliant and conscientious lawyer who will analyze and decide cases in good faith, applying the jurisprudential principles to which she is committed. Those are the basic criteria for being a good justice. Barrett meets and exceeds them," the Liberal professor said.
Feldman said that whether Trump wins or loses, the confirmation of Justice Barrett was certain. Coincidentally, the Senate majority leader, Mitch McConnell, disclosed that he already has the numbers to push the confirmation. The professor said that given the Republican domination of the Senate, he preferred having a strong candidate to fill the position.
"Given that reality, it is better for the republic to have a principled, brilliant lawyer on the bench than a weaker candidate," Feldman said. "That's Barrett."
He described Barrett as a thoughtful, sincere, and lovely person. Her qualities made a scary combination for the Liberals, according to Feldman. He also described Barrett as a true conservative despite her catholic faith. The Harvard Law professor said that her faith did not disqualify her from serving in the Supreme Court.
Feldman and a few other Liberals are trying to appear principled because there was very little they could to stop her. The only option they have is to take the high road and claim to disagree with her on principle.
However, that hasn't prevented the bottom of the barrel Democrats from making false allegations and attacking Barrett's faith. Her confirmation hearings will begin on October 12, 2020.
