Warrant served on Missouri Couple and Police Confiscate Their Rifle
While police have not found any grounds for charging the McCloskey’s, they continue to harass the law-abiding couple who were minding their own business until the rioters broke into their property and threatened them.
St. Louis police obtained and executed a search warrant in the couple’s home, taking away the rifle displayed during the encounter with BLM demonstrators, according to KSDK-TV. The attorney representing the couple had taken possession of the pistol that Ms. McCloskey had during the incident.
The family attorney said there are no grounds for pressing any charges and that he does not expect any. Anders Walker, a criminal law professor at Saint Louis University, says the couple had every right to defend their property using Missouri’s Castle Doctrine.
The professor said the Second Amendment provision covered both the land and the property. Additionally, the protesters had no right to invade the private street and compound. McCloskey said he only retrieved his weapon after armed protesters broke a gate and got into the private property.
St. Louis police investigation hopes to find an excuse to charge them to satisfy the anti-gun sentiments. Circuit Attorney Kimberly Gardner vowed to hold the couple accountable for their actions, although there is nothing to be held responsible for. The prosecutor cannot comprehend why a couple facing threats defended themselves against the violent demonstrators.
Missouri Republican Sen. Josh Hawley said the investigation of the couple was insane and amounted to an abuse of power by the prosecutor. Sen. Hawley added that the prosecutor had failed to prosecute many violent offenders whose files were collecting dust on her desk but allowed them back on the streets.
